By accessing, viewing, downloading, or otherwise utilizing all original works of authorship, including but not limited to manuscripts, articles, documentation, videos, websites, PDFs, Facebook groups, Facebook pages, images, chats, text messaging, phone calls, and verbal communication, created by Renee Blossom Frey (collectively referred to as the 'Content'), you acknowledge the following and release Renee Blossom Frey, and its owners, agents, producers, employees, independent contractors, and vendors (hereinafter “Renee Blossom Frey”) from all liability including indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Content (this “Release”):
- You are aware and understand that some materials discussed in the Content for Renee Blossom Frey are not approved by the United States Department of Agriculture (the “USDA”). As such, use of the Content is done at your own risk and best judgment. Renee Blossom Frey offers no assurances regarding the particular use of the Content or its safety. If you have any concerns about this Content, you are advised not to use it and instead follow USDA guidelines regarding the canning, pickling, or other preservation techniques regarding food.
- You are aware that using the Content may come with risks and may result in serious injury. You are aware of the dangerous nature of bacteria and viruses and acknowledge that Renee Blossom Frey makes no assurances regarding the safety of the Content. You acknowledge that these risks may result from or be compounded by the actions, omissions, or negligence of Renee Blossom Frey. You understand that Renee Blossom Frey cannot guarantee that you will not be injured or become sick due to using the Content. NOTWITHSTANDING THESE RISKS, YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY USING THE CONTENT WITH KNOWLEDGE OF THE DANGERS INVOLVED. BY USING THE CONTENT, YOU HEREBY AGREE TO ACCEPT AND ASSUME ALL RISKS OF ILLNESS, PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS ARISING THEREFROM, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE Renee Blossom Frey OR OTHERWISE.
- By using the Content, you hereby expressly waive and release all claims, now known or hereafter known, against Renee Blossom Frey and its owners, employees, agents, successors, and assigns (collectively, “Releasees”) on account of personal or psychological injury, illness, pain, suffering, temporary or permanent disability, death, property damage, or financial loss arising out of or attributable to using the Content, whether arising out of the ordinary negligence of Renee Blossom Frey or any Releasees or otherwise. You forever release and discharge Renee Blossom Frey and all other Releasees from liability under such claims.
- While using the Content, you will also follow all instructions, recommendations, and cautions of Renee Blossom Frey at all times. If you believe conditions are unsafe at any time, you will immediately discontinue further use of the Content.
- This Release constitutes the sole and entire agreement of Renee Blossom Frey and you concerning the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, concerning such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable, such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of Renee Blossom Frey. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Tennessee without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Cheatham County, State of Tennessee. By using the Content, you hereby consent to the exclusive jurisdiction of such courts.
